I work for a retail company so we are open most holidays. Our company offers time + 1/2 for working holidays.

I worked 45 hours last week 10 of which was on a holiday.

Am I entitled to 5 hours overtime? They are telling me since I worked 10 hours holiday I am already getting time and a half therefor my regular hours are only 35 hours. Even though I physically worked 45 hours

You are entitled to 40 hours at straight time and five hours at time and a half.

If you are being paid 35 hours at straight time and ten hours at time and a half, you are getting more than the law requires.

You worked 45 hours.

Legally, the company needs to pay you 40 straight and 5 OT, the equivalent of 47.5 straight.

You got paid 35 straight and 10 OT, the equivalent of 50 hours straight.

And you are complaining?
