You can however, file a claim with the DOL for unpaid wages for free. No lawyer required.
lleoun 05-17-2007, 10:20 AM The department of labor only helps people who makes less that $600 per week. I was doing a little more than that, but anyway they won't help me. It's an odd situation, don't have much money for a lawyer, and it's a good deal of money what my company owes me.
Pattymd 05-17-2007, 11:45 AM I think it's gone up a little since the increase in the minimum wage, but still. I know it doesn't seem quite right, but it "is what it is".
Unfortunately, I doubt that you'd qualify for Legal Aid or similar, at more than $600 per week, although I also know that amount doesn't go very far in most parts of New York.
How much are we talking about here, total? Do you want to share what wage and hour law you think was violated? Just asking, because a lot of folks think something is "illegal" when it, in actuality, is not.

lleoun 05-18-2007, 07:52 AM I quit a week ago, and during all this time I felt totally stupid and fustrated.
The reasons why I was with them, even when we were not getting paid, were first of all, that I believed in their lies. They were showing us documents from the bank explaining that the money was there and just need time to be cleared, and documents from court where they were supposed to be suing another company that owed them lots of money. But after all this time I'm totally sure that the documents were a fake as we've seen them behaving suspisiously in another areas too.
As I was fooled with the documents, time passed by and they already owed me an amount over the limit for the small claims procedure. At that moment I though that if I was leaving then, I wouldn't get back my money. So I decided to wait some more as they kept on showing more documents about the inminent economic recovery (some more fake for sure).
Finally, I also loved the proyect I was working in, I took me lots of effort and I took it as mine, it was really difficult for me to abandon it.
Still, feeling stupid as you can imagine it.
Beth3 05-18-2007, 08:01 AM I find it very odd that your State DOL has said they can't help you with your unpaid wages but do contact the federal Department of Labor - 866-487-2365. I can't think of any reason why they won't be able to assist you.
