Child turned 18 in Mar 07, failed senior yr of high school due to excessive absence. Mother wants to send them back another full year of school for 2 hrs a day rather than have them get GED or summer school. So far they have no interest in college.
The divorce stated support is for the minor child. So my question is, do I have to pay another year of CS? There are no guarantees that the 18 yr old will even attend enough to graduate, like last year. Actually the 18yr old doesn't know if they plan to go to school or leave home or what.....you know how 18 yr olds are.:rolleyes:

If the child is not enrolled full time and in good standing at a secondary school, AND it's not specificed in your divorce papers that you pay past 18, then the support should end at 18. But you really should consult with an attorney. Are your wages being garnished?

The court papers say support is for the minor child, and the amount. Doesn't specify extension for schooling or any other situation. Wages are not being garnished, no arrears, I've always paid on time & voluntarily upped what I paid her several years ago.
Would child be considered in good standing for excessive absences at school? Is 2 or 3 hrs of school 5 days a week considered part time? I have no way of knowing if they will even enroll at the end of the summer or if the school will allow them to continue education.

I would suggest you keep making your payments until you consult with an attorney. You may need a court order to end CS since the child is still in high school and still living at home.
Reaching the age of majority does not automatically terminate child support payments. If you have paid too much, your attorney can ask that those payments be returned. Better to be owed than to owe.

Get a consult with an attorney, the info I have (might be out dated) says that CS ends at age 18, unless the child is in high school, then it can be at graduation or age 19, whichever occurs first.
