In jersey you have to go back to court for emancipation. Child turned 18 Dec 8 2006 and has not been allowed to have contact with noncustodial. She has been taken out of the country without permission repeatedly, visitation has been denied for no reason but jealousy and to top it , she was ordered in 1996 to take his name off the house and did not until he contacted the bank in 2005 and made a scene. She then after repeated calls to her lawyer with laws that would cause her problems, she finally did this and in the meantime ruined his credit after using it fraudulently for 10 years.
So, we filed the papers and paid the fees and of course are paying 1000 a mo support when he makes 15K and she makes 70K. Go figure how she did that one??? LIED and lied.
So, now after knowing about the court date for months, they send a figgin letter saying both her lawyer and her had holiday plans that following weekend and want the hearing postponed from friday am. Now how convienent. 10 years and trying to pull more BS> We called the court and left a message that we do not agree with a change, they have done enough damage and no more delay after 10 years should be allowed. He has given up 10 years of vacations and not even a day of visitations!!! We eat beans and are on foodstamps while she takes cruises and international vacations and got the 200K house free!
What else can we do to enforce our rights?? We are in Iowa and they are in jersey. We even moved in 2003 to be close to them and was not allowed to see her etc. Her jealousy is bright green!! So with that we moved back where we both could find jobs in the midwest and cheaper living.
We were promised 2 weeks visitation last year and got lied to again. That controlling lesbian needs to get over it. Her and her domestic partner went to scotland repeatedly and not advising the courts or the noncustodial.
I got MS and he has been laid off since feb 14th but she still got all her money while we did without!!

I agree, without a question, the only thing I can see is a modification of child support, based on what the poster said, they both make, but that will not change what the poster owes up until the modification. Other than that, I do not see a question anywhere!!

What "showdown" are you talking about? Is there a court date, and what is it for? What do you need to "prepare" for?
Unless their is a court order that specifically says the mother is NOT allowed to take the child on vacations overseas, it is allowed. And it is pretty common for parents and grandparents to purchase a car for a kid for highschool graduation. My parents let me take their car after I graduated. It did not turn me into someone who doesn't know how to earn their money.
If CS is too high, file for a modification. If the mother is using the exes credit cards without his permission, file charges.

Why would he have a say in where she goes to college anyway?
And why was his name on the house? Did he buy it with the mother?

In NJ, child support does not automatically end at 18. The parent paying support needs to file to have the child DECLARED emanciapted, which, in NJ, would be when the child is 18 AND out of high school.
This is not a "battle." It is a petition to end child support based on change in circumstance. You should start your "preparations" by realizing that.
It does not matter if the child hasn't seen the father. Child support and visitation are two different issues. Dad cannot let go of his support obligations just because he and the child haven't spent any time together.
And, as I said, the fact that they were not married has no effect on college payments. A judge can order both parents to pay part or all of college tuition costs regardless of their marital history. Courts do NOT make blanket decisions that children of non-married couples don't get college support.

If their CS order states that he has to pay part of college, he does. If it does not say that, then he doesn't. ~ Thank you for that clarification it is not mentioned in the support just visitation anytime and calls anytime and the amount. So, as the rules state~ not required.
Is there a court date, and what is it for- june 8th and emancipation, enforce litigants rights and contempt of court by custodial.
