I am a pt employee. Because we got less business than usual this winter, my supervisor urged us to apply for unemployment. When we did, one of us received a call from the owner stating that if unemployment comp were pursued, that employee would be terminated. The other did not receive the same threat, but upon filing (and receiving) unemployment, neither employee was ever scheduled again. The employee that was threatened was in fact terminated, while the other one is still on the books but will most likely never be called back to work. Is this legal?

It is illegal for an employee to suffer an adverse action from an employer for claiming UI benefits.
Are you sure you are terminated? And for filing the claim?
Sometimes employers do not report the quarterly earnings to the government like they are required to by law. I have had this happen to me before .
It is an employees right to pursue UI insurance. Someone may come along that has more lnowledge than I .
Your employer is wrong for the statement made. Let the EDD adjuster know this. The employee that was terminated for filing a claim should file a discrimination complaint with the DFEH.
