My fiance' lost his assistant and his work is as in the past dragging their feet to hire a new one. He has so far worked 33 days without a day off even though he as made it quite clear that he needs at least one. Is this legal for them to do this to him?

Is he exempt or non-exempt?

What industry does he work in?

It makes a difference to the answer.

What does he do at the hotel?

Exempt from overtime under the Fair Labor Standards Act. If you can tell me what his job duties are, we might be able to determine it from that.

I'm not being obstructionist here. Massachuestts One-Day-Rest-in-Seven law is a limited one that does not apply to all industries or all employees. If it does not apply here, then the employer is legal.

That really doesn't tell me much. But it doesn't appear to matter since hotels are not among those industries where the law requires a day of rest every week.

It's rough, I know, but this is not illegal.
