First of all, height is not a protected characteristic in NC, or in any state except Michigan. So EVEN IF this was discrimination (which it isn't) it would not be illegal discrimination.

However, you were told that your employment was conditional on being able to drive a bus. For whatever reason, you are not able to meet that condition. They are not obligated to waive that responsibility because you are too short. The statement you posted specifically states that you can be disqualified for employment if you are unable to meet that requirement.

This is not discrimination.

I can only answer based on the information you provide. You did not indicate in the first post that you had learned there was no such rule, and I'm not convinced that being short is necessarily a disability (I'm 5'2", btw). Even if it is, if this happened in September of 05 you are past the statute of limitations for filing a claim with the EEOC - when did you contact them?

come down here to my height, and see if you say that. if i were 5 2, i wouldn't be in this situation. three inches might not seem like a lot, but it would make a big difference in my life.....just day to day functions. i am short enough to have qualified for growth hormones when i was an adolescent.

It seems weird that if you tutor children that you would be required to drive a bus... Being the devil's advocate that I am sometimes, I would wonder if their policy to require driving a bus and needing to be at least 5' to drive a bus was done in an effort to hinder more women from being employed.

I too am short and have heard a few threads of short people being discriminated against. Luckily, that is the last thing that seems to bother people about me.

What if you wore "Marsh Mallows"? Those big shoes from the 70's that made you at least 3" taller. My also short brother loved that style back then.
