Hey our court hearing is very soon so I wanted to ask a question. The mother (noncustodial parent) is a bartender at a hole in the wall bar nearby. She is claiming she only makes $25.00 a day at work so when CS is ordered she wont have to pay much. But that is because she makes that plus tips. Will the courts factor in the tips or will they figure it up based on a minimum wage full time job. What do they do cause you and I both know she makes more than 25.00 a day or else she wouldnt be working there. Any help please!!

The court will probably impute income at minimum wage, unless her tips can be proven. Unfortunately, that's very hard to do without having her taxc returns with tips listed.
Besides, do you really thing she's going to have this same job when it actually goes to court?;) It wouldn't surprise me at all if she quits right before the hearing, it'd be so, "Allisony" wouldn't it?
