View Full Version : Custody question Mom in Cal. Dad in FL Florida

Here is my dilema. Over the past few years my Ex has lived in California our divorce and custody had been set up in Fl. I have moved around to various jobs so I am not fighting to make her move back to FL or argueing about her moving.

I went out to Live in Cal. last year and had trouble making it finacially. I got a really good job with a goverment contractor so moved back to FL. When I left it was discussed by My ex , my son and me that IF he wanted to move to live with me after his current school year is over he could. Well he decided he wants to move this summer. My ex is pissed to say the least. She wants to take me to court for back support ( I am not behind at all. just no actual proof I could prove in court ) Says I am only doing this to get out of support and she still expects me to pay my Child Support . ( We have 2 children Daughter 11 , Son 15, son is the one wanting to move ) Their mother can get a little intense and really rides them both hard, way to hard in my opinion which is why my son wants to be with me.

My question is do I still have to pay her support for my daughter, and if she does not let my son move would I have grounds to file for custody of him on the grounds that he wants to move and he is 15.

She has a good home and job and overall is not a bad mother and takes good care of them. She is remarried and her husband works and is good to the kids so there is no distress other than her temper and yelling at times for the littlest thing.

You will need to file for a modification of the custody, visitation and CS orders. That is the only way to prevent later problems. In the mean time, the existing orders must be followed, until they are modified by the court.

Thank you . Got in touch with Fathers advocate group today they are going to help me with legal advice and getting all the proper paperwork filed.
