I am a manager at work. I have a new boss that calls me in his office on an almost daily basis and tutors me on how to act and always what I,ve done wrong etc.I've managed my dept. for 5 years now with no complants from anyone.I'm having a hard time coming into work now because of the stress
and worry about my job and what he is going to say to me today.My only employee has left and they are not going to replace him.I don't think I will be able to do I all and that stresses me also.Can I leave because of stress? If so how do I go about it?I'm in NY

You can leave for whatever reason you want. You say, "Mr. Employer, this is my resignation effective xx/xx/xxxx".

But you won't be eligible for unemployment, if that's what you're really asking.

What I meant was can I go on leave because of stress? Like a disability.

Ah, the myth of "stress leave" rears its ugly head again.

There is no such thing as stress leave, if by stress leave you mean a protected form of leave with definite parameters. I have absolutely no idea where this notion comes from.

You can take medical leave under these circumstances IF AND ONLY IF your doctor is willing to declare that you are medically unable to work due to a stress-related or stress-induced illness, and put it in writing. I won't even pretend to guess whether the state of NY will accept it for a disability claim.

If your employer offers a form of personal leave of absence that might be less of a hassle for all concerned.

Don't forget that the problem will still be there when you get back.
