View Full Version : Can my girlfriend move from NC to Ohio with our kid w/o my consent?

I live in North Carolina with my girlfriend. Her mother will be driving down this weekend and she plans on moving to Ohio with my kid. Legally, can she do this? I AM on the birth certificate. Right now, there are no custody agreements. Can my girlfriend move from NC to Ohio with our kid without my consent?

With no orders in place, then yes, she can do this without your consent.

You may not be able to stop her from going, but first thing tomorrow, file for a determination of custody/visitation. You should hire an attorney, and my own personal opinion is that you should let her know you are doing this.

Even if she leaves, you can likely compell her to return the child to the state for the custody proceedings.

Did you have a falling out? Are you still living together?

Did you have a falling out? Are you still living together?We are still living together, but not on the best of terms. Is there ANYTHING I can do to prevent her from taking the child?

You need to speak to an attorney first thing. There is always the possibility of an emergency hearing, but I can not be certain if you would qualify.

I don't know you or her, but sometimes, telling the person of your intentions can stop them. Are you two still co-parenting together? Is there a chance you can talk it out?

I don't think you can force her to stay, but once you file, you can force her to return the child.

i am here in florida and i am taking my son mother for child support it took 3months to get a court date but now me and my wife are moving out of state. do i continue to go with the court date or should i cancel it and reapply when i get where i'm going. i am planning on coming back when the court is schedule. what would be the best interest? please give me some ideas thank u

You really should start your own thread. This one is just a few days old and the original poster may return.

When you start your own thread, though: is there a custody/visitation order in place with your child's mother? It is usually not posible for you to just up and move out of state without permission from the other parent, especially in Florida.

i have full custody and visitation is only aloud when agreeable by both party so basically when i allow him to go over there. the case was done in nebraska family court system not florida. does this make a different from what i was saying.

Where does your ex live?

If you are moving away from where ex lives, you will need to get the court's permission to move, or ex's permission and then notify the court.
