Is this policy valid?

Policy that immediate relatives and other close personal relationships (sibling, parent, child, spouse or roommate, etc.) of any current employee may not be considered for new employment in situations where the company in its sole discretion feels there is an inherent potential for conflict of interest.

Why wouldn't it be?

And not only is it legal, it is common and advisable.
