Is Overtime for a non-exempt employee calculated based on a 40 hour week, or an 8 hour day (or other scheduled time frame?)

Concerning a part-time person who worked 12 1/2 hours in one day, but still didn't work over 40 hours in a week. Are there any OT hours due to this employee?

Some states require daily overtime.

Ohio is not one of them.

The employee is owed overtime only if there were more than 40 hours worked in the work week.

California, Alaska and Nevada require overtime for over 8 hours in a day.

Colorado requires overtime for over 12 hours in a day.

In ALL other states, overtime is only due after 40 in a week unless otherwise provided by bona fide contract or CBA.
