Hello!

I have been to BOLI and read the federal laws, but I'm still wondering - is my boyfriend an Exempt employee? He is a welding shop supervisor, he does direct employees in their daily activities, but have no decison making power in determining their wages, or promoted status. Occasionally, he is asked for his opinion, but by and large he is not the decision maker. Recently, although he is a salaried employee, his employer was going to dock his pay for a day he was out sick. It wasn't until he confronted him that the day was re-instated to his wages. He still has to clock in everyday at work, however, he also keep track on my hours everyday in his calendar.
He is not in charge of any reports, or budgets (in fact, he doesn't even have a computer in his office). He still works in the shop building and tuning machines.

He was fired yesterday for an argument with an office employee.

Can anyone help me figure out whether or not he has been due OT? This has been an ongoing question for me (since he averages 80 hours of OT every 3 weeks and has never received any extra pay).

If your boyfriend's primary job was doing manual labor, he has a case that he can take to the Department of Labor (federal or state) for payment of overtime.

Given what you posted, I suspect that your boyfriend is not exempt.
