 My son is 4 months old. The relationship with his father is not going well. I have no family where I currently live. He has told me several times that no way in He** he will let me take his child away from him but I can't afford to live in this college city by myself. Do you think it will be a long and hard custody battle? What should I do first? I am so lost. I don't want to take his baby away from him but I can't afford to stay here and I'm not going to continue to keep my son in a bad enivroment.
Thanks.
I'm sorry that subject is wrong... I'm moving TO kentucky

Do you live IN Florida and want to move TO Kentucky?
Xena is the most knowledgable on Florida law, but the short answer is yes, it would be a long and hard (not to mention expensive and probably losing) battle to move from FL to KY without the consent of the father. Florida law is very strict about not letting one parent high-tail it out of the state with the children.
Is he the LEGAL father? Are there any support or visitation orders currently in place?

The best thing to do right now is to get a consult with a family law attorney who can answer all of your questions at once. You can get a 30 minute consult for $25 by calling the Florida Bar Lawyer Referral Service at 1-800-342-8011. When you go to your appointment be sure to take a list of your questions and all legal papers you have (court orders for CS/custody/visitation and your child's BC).
