Is your name listed on the mortgage?

It's not that easy to give up your marital rights.

I am not on the mortgage loan, but I am on the deed
Why is it not easy to give up my marital rights?
We will Divorce, and are filing a speration agreement, but I no longer want my name on the house

But, why? You have the right to some of the equity in that home. You have the right to use that equity to offset some of your expenses.

I'm confused. It appears that you are not getting divorced, but will still be in the home, right?

You do not want to do something now that you may regret in the future. Determine your equity in the home - your share should be half. Are you getting sufficient value elsewhere? Over time real estate always goes up - is this an asset (investment) you want to give up? If the market is in a slump in your area, is now the best time to determine your equity based on your homes value?
If you quit claim the home to your husband, what guarantee do you have that he will let you live there? Do not count on the fact that you have children together - you could be out the door with no recourse. What if he decides he is going to sell the home?
This is what I suggest - you see an attorney and have a separation agreement prepared setting out all of your rights to property, children etc. and your ability to remain in the home. You will need clauses dealing with his right to sell, the term of your being able to remain in the home (so long as the children are dependants?)
Please get advice - do not let your husband be the only source of information you are relying upon.
