I HAVE NEVER BEEN IN TROUBLE WITH THE LAW OR DONE DRUGS OR BEEN A STRIPPER THESE ARE THINGS HE HAS TOLD THE COURT BUT THE NEVER HAD HARD EVIDENCE SO THEY COULDNT USE IT THE FATHER HAS BEEN IN AND OUT OF JAIL AND HIS PARENTS TO. Anyways when he put her in school 5 years ago i went right to the court and and got the case reopened because he was messing with my time i had with her before all this he would get every other week with her because she wasnt school age yet. this happened when i came and moved back to California from Lousiana. When he went to jail the first time was when i had just got married and he went to jail for credit card fraud. But he has had been in alot i have all his crimnal papers my lawyer gave to me and when he had custody i just went with the flow intil my child started saying she didnt want to be there and that she had failed first grade and i then went up to the school and talked to the principal after i had called so many times to find out what was going on. The reasoned i called is because i lived two hours away and working. And to answer that question how did he put he in school when she was 2 years old it was head start. And he was suppose to have my permission to do that and the school never notified me about nothing concerning my child even when i told the teacher to telll me when she was getting an award or doing bad just to call me and that never happened.

If you have joint custody, and you never filed to modify the order when he went to jail, then when he got out he was entitled to have the order enforced exactly as it is written.

Therefore, if she was with him most of the time before he went to jail, then yes, he is allowed the same thing now that he's out.

Next time he goes to jail, file to modify the custody order.

Unless his crime somehow endangered the child (which I am guessing it did not as it was for credit card fraud), then his rights as a parent remain in tact. Courts do not strip parents of their rights when they go to jail unless the reason for incarceration is hurting that child, another child, or in some cases, their crime is violent. That said, there are parents out there who STILL maintain their rights even AFTER hurting, abusing or even molesting their own children.

Yes, he's a criminal. But from what you described, he's a petty one. Until he endangers the child, he will remain in her life. And until YOU file to modify the order with good PROVEABLE cause that it be modified, your arrangement will stay the same.

That does not equate into HER being unfit to raise me.

Do you live far away from this man? Do you live in the same jurisdiction? Why did you not petition for permenant custody when he went to jail? Temporary is just that: temporary. Your attorney should have informed of that. In order for her to remain with you, you would have had to petition for permenant custody.

As I said before, if you did not file for a permenant custody change, then he was well within his rights to have the original order put back in place upon his release.

As to your other assertions about the attorneys... first off, it is not uncommon for a judge to be friendly or even friends with one or several attorneys who appear before him or her. They are basically co-workers. The same way that any of us may be friends with our superiors, that does not mean that we cannot also get our work done properly and in a timely fashion. Just because my boss buys me a beer now and then doesn't mean he lets me get away with not actually working. I would seriously caution that you NOT take the route that somehow the proverbial "fix" was in on your case. Unless you have real live PROOF that the judge was somehow bribed or encouraged to side with your ex, you will end up in jail for that accusation. Then BOTH of your child's parents will be criminals.

As far as suing your own attorney, I understand that you feel you were not well represented. But that is a pretty hard case to prove unless you have solid proof of the attorney's incompetence. My non-legal opinion is don't bother. It will cost you time and money and in the end any monetary win you get will probably be extremely insignificant, plus you will have wasted effort you could have been applying to your current situation. Just move on.

news flash- if the school was that concerned, they would have - by law- had to have called CPS. If you are that concerned, pick up the phone and call them. They will investigate and if half of what you are saying goes on in that house can be substantiated, then you have a good chance at a change in custody
