What is the labor law on paying hourly employees to travel 5 hours by car to a conference where they man an exhibit table for another 5 or 6 hours perday? Do you have to pay for the time in the car traveling? What if they sit at a table for 12 hours per day, do they get overtime? thank you for your input:)

That would depend on issues like are they salaried exempt or salary non exempt, things I am not a pro at, but cbg, Pattymd, Ellemd, are. If they are just straight up hourly pay workers, I would think they are entitled to get paid for the time they are in the conference, not sleep time, if it is more than one day. It is my understanding that they may not have to pay you for drive time. If you have to go to the shop, and pick something up that is vital for this conference, then it is my understanding that you are to be paid for going from A (your work office) to B (conference). It is different for different situations, like if you are union or not, and if it is in your contract to be paif for this. Please wait for further answers, as I know mine is just not good enough.

lindabow: Do you have to pay for the time in the car traveling? YES.

lindabow: What if they sit at a table for 12 hours per day, do they get overtime? YES. Time-and-a-half for all working hours over 8 hours in a day up to 12 hours. Double time for all hours over 12.

That is great, do you have a link to provide for this information. I would love to save it on my computer. I found an awesome link for california labor laws, and rules etc, I love how much it showed me, but it did not include this situation. Here it is, you probably have it allready lol!

You can link to my many years of study, training, teaching, and professional experience on the subject ;)

If you need more, here is the opinion of Anne Stevason, A DLSE attorney, on the subject http://www.dir.ca.gov/dlse/opinions/2002-02-21.pdf

I am sorry if I came across as though I did not believe what you said as true, it is just that I am learning to help people here, and they frequently ask where do I find a link to prove this to so and so. I wanted to offer them a link, if I happened to answer a question like you just did. Once again, I am so sorry if I offended you, I am fully aware of your expertise, and I appreciate you being here to help me and others learn about the law!!:p

Is that true in California for passengers in a car as well? Or does the state follow the US DOL rules on that?

That's my understanding, Scott, yes. Unique to California, as usual.

Scott, if the passengers are employees, they must be paid.

Gotcha, Barry. I figured that might be the case, especially the way you stated your response with no qualifications, but just had to ask to be sure.
