An employee at my company submitted her resignation by email yesterday. She would like her last day to be April 25th. We would like it to be effective immediately. Is this possible? I thought it was but she stated that she would work through the 25th of April or I would still have to pay her through then because that is when her resignation is effective.

It is my understanding that I can accept her resignation but make it effective immediately and only pay her for days she actually worked. Also, if I do this, would it still be considered a resignation or a firing?

Thanks!

You do NOT have to let her work until the day she wants the resignation to be effective nor do you have to pay her beyond her last day of work (true for both exempts and non-exempts).

It is a resignation that has been accepted immediately, but the employee MAY be eligible for unemployment benefits from the last day of work until the date she intended to resign.
