We are required to be on-call for support issues 2 weeks a month and are required to carry the pagers with us 24/7 during that time. The first week is primary on-call and we are required to acknowledge the page within 15 minutes and depending on the severity to have the problem resolved within a 4 to 72 hour period.

The second week you are required to be the secondary on-call and if the primary doesn't respond within 15 minutes then it goes to the secondary and then you are required to have the situation resolved still within the 4 to 72 hour period.

Is the employer required to pay us for this time while we're on call as we have to respond to the page within 15 minutes?

In this day of pagers and cell phones, you're not stuck in your house when you're on call. You are free to conduct your personal life as usual. If you are non-exempt (paid hourly), then all the time they're required to pay you is for time actually worked.

Hi Beth

Actually we are required to be near a computer at all times because we have to remote in to the system(s) if it's a Severity 1 or 2 and have this resolved within 4 hours. If it's a lower severity (3 or 4) we can resolve this the next day but the problem is that we obviously don't know if the pages are going to be a Sev 1, 2, 3 or 4.

OP - as you can see from previous post, it depends on various factors whether you have to be paid when on call or not.
