View Full Version : Not sure of my rights or what to do Tennessee

I have currently been working at my new job for almost 3 months. on mon(april 9) my supervisor calls me at 7pm to tell me not to bother coming in to work that night at midnight. i asked her why and she said it didnt matter but to report to her office to meet with her and her supervisor the next morning (april 10) before 9am. i asked her why and she said she couldnt tell me. i then preceded to tell her i needed the hours and ask if i could work my night shift anyways she said no. i was at her office at 10 til 9 in the morning and was made to wait until almost 10am to be seen. when i went in to the office i was told that several staff have complained about me. including me there are only 6 staff at the house i work. they told me specifcially that 3 did not report me. that leaves two, one of who ive never worked with thus leaving one person. i was told they had said i was sleeping on the couch with a pillow and cover for hours at a time, had been reading books, and was neglectful to patients and did not interact well with them. first off i told my boss that it was impossible to sleep on the couch because one of the patients there would not even let anyone sit on that couch without pinching you and getting violent. her only reply to this was well i know you have worked in your jacket with the hood on when its cold. ok but that has what to do with this? next i told her that her, my house manager, and several staff had told me to bring a book to read because it was slow on weekends. she then denied saying this. so i ask her what i was to do when we had our work done and other staff was talking on their cellphones for hours at a time or playing on the computer. she said clean. i ask her what she wanted me to do considering she had put me on restrictions because im almost 6 months pregnant. she named a few things and i ask her if she thought it would take me 16 hours to do that since i work 16hr shifts. she had no reply. next i ask her if she could be more specific about the supposed neglect and poor interaction. she told me she wasnt given any specifics on this matter. yet i still was written up over this. i had never been written up before so when she told me to sign my write up because it just meant i had been presented and read it, i did. i did not know i could refuse to or state i disagree with the write up. i did ask for a copy of my write up which i was then told i could not have unless i was no longer working there. and right before i left i was told that i was not allowed to discuss this meeting at all especially to staff. well about 5 hours later i had to call my house manager(who is also the girl they indicated reported me) to tell her she needed to get in touch with me or another staff member who was trying to reach her asap. not even 30 minutes later i get a call from my supervisor telling me she thought she had told me i could not talk to staff members. i informed her it was non work related and none of her business who i talked to on my off days. she then preceded to tell me the same thing i had heard in the office that morning about not repeating my write up to employees or i would lose my job. i ask her if that was all she wanted and hung up on her. so my question is have my rights been violated, if so what can i do, and i want to quit this job because i forsee this becomeing a larger problem should i quit or let them fire me or what?

No, your rights have not been violated. The allegations against you are very serious and you do not have the right to know who exactly said what about you. Most employers will not share this as they fear an employee could then retaliate against the accusers. They have every reason to expect you not to approach your coworkers about this for the same reason.

I don't see how your pregnancy has anything to do with this at all, especially since you were already pregnant when you began there.

And not that I can add anything to ElleMD's response, but in the future, please use capitalization in your sentences and maybe some paragraphs. That huge block o' text the way it is, is very hard to read.
