Hello,
I'll try to keep this as brief as possible. Not sure if this is the irght forum for this, but here goes.
Basically, 3 weeks ago, the president of our condo association hand delivered a letter to my roommate and I that stated that there had been some complaints about our dog and it's droppings not being cleaned up immediately. It also stated that if another violation were to occur, we could be assessed a fine. Fine, I absolutely agree that it's gross and should be picked up immediately, unfortunately, I let laziness and the cold weather keep me from doing it each and every time. So the next day, I went out to clean up anything that my dog produced that was out there. While doing so, I noticed there were a couple other "piles" that were obviously not from my dog (She's a 7.5 lb toy fox and this pile was probably the size of here entire body). So, I called the president to let him know that there are others who are leaving piles on the lawn and I have personally witnessed other residents allowing there dogs to "go" and not cleaning it up so that in the future, my roommate or I would not be immediately blamed for someone else's "piles" just because we now had a "record".
Well, since I received that letter, I have been extremely vigiilant about cleaning up every single time she went to the bathroom (something I should've done from the get go). There is not one instance that I hadn't since we got that letter.
Well, today, we received a notice that we were being assessed a fine of $25 for a second violation, basically for non compliance of the initial letter. But as I said before, I've left NOTHING behind, so I'm not sure why we're being assessed this fine at all.
And since I know I didn't leave any piles, I know there can't be any proof of such a thing. I realize I can refuse to pay, but then they'll just charge my roommate who actually owns the unit. Is it reasonable to demand proof that it was my dog that did this? It seems like they should have some amount of evidence that I was the person who did it before they can just fine me. Do I have any course for action at all here? Or am I pretty much required to pay the fine whether it's right or not? I'm just worried that they're going to keep assessing fines for this and eventually I'll have to get rid of my dog because some neighbor is letting their dog crap on the lawn behind my unit and I get blamed for it.
