My company offered a buyout to all employees, it was a cash offer along with a short benefit period. The buyout was appealing because it was a union contract negociated with further cuts in pay. (I had 4 paycuts in 2 years) I applied for unemployment the week after my last day and was granted unemployment. This was May 22,2005. I just received a letter dated April 2007 indicating my employer was contesting my unemployment claim. My unemployment benefits ended in December 2006.

I thought I was eligible for unemployment because I have a great deal of friends that were bought out by a company in NJ and all of them collected.
My 2 questions are am I eliglble? and isn't there a time limit for when a company can contest an unemployment claim?

Why in the world the state would be accepting an appeal from the employer at this point is beyond my comprehension.

There is a time limit. If memory serves, NJ has either a ten (10) of fifteen (15) day time limit from the date of the determination by which the aggreieved party. Based on your post, that date has long ago past.

Does the Notice of Hearing reference timeliness as an issue?

I received, from NJ DOL, a "Claimant's Statement for Issue Clarification" its asks quite a few questions like, my former rate of pay, last day worked, what kind of work did I do, did you notify your employer you were leaving...etc. Its asks that my response be faxed within 14 days. The PDF file that Pattymd refers to seems to apply to disability claims. I couldn't find a reference to a time limit on an employer's right to appeal. Thanks so much for your quick responses.

Oops, my mistake.:o However, I still contend that, after two years, they are WAY past the time limit to appeal. Did you search that document for "right to appeal" regarding UI?
