View Full Version : Hourly overtime for Travel in California

I've looked in many places and can't find the information I need.

First of all we are located in California. We took our Admin. who is paid hourly (of course) to a Career Fair in Michigan. On Wed. she worked from 11am to 4:30pm and then our flight left at 9pm and arrived in Michigan the next morning at 8:30am. She got to the hotel around 10am and then we met back up at 2pm, the time between was freetime and then worked till 11:30pm. Thursday was working all day from 7am to 11:00pm. Saturday was another all day, working from 8:00am till 11:00pm. Sunday's hours was all flying back, which was 5:15am till noon. Some of the time in each day was for breakfast, lunch and dinner.

I guess my question is what is the law for hourly travel. Is there a normal amount of hours a company is required to pay and is it for flight time as well.

As it stands now her timesheet reads:

Wed. 6.5 reg hours
Thurs. 8 reg, 4 ot, 4 dt
Fri. 8 reg. 4 ot, 4 dt
Sat. 8 ot, 7 dt
Sun. 8 ot, 1.75 dt

Hourly, non-exempt employees must be compensated for all travel hours (including those spent sitting on a plane). The law does allow you to pay different rates of pay for different job duties (e.g., sitting on a plane can be paid at a lower, hourly rate-of-pay than "regular" work), but you need to be careful here, especially if you did not advise her in advance that you would be paying her at 2 different rates.

Observation: In looking at your s/t, o/t, and d/t figures, I'm not sure why you are paying d/t for all hours over 8 on Saturday & Sunday. Is that your company policy?

We are paying her ot on Saturday and Sunday and then the remainder is dt. By end of day on Friday she had completed her 40hrs for the week.

You are miscounting and pyramiding OT hours. Assuming you have properly captured all working hours, you only have to pay your employee 3 hours of double time on Saturday (the other 4 hours that you have listed as double-time can be paid at time-and-a-half). For Sunday, the 1.75 double time hours only need to be paid at time-and-half.
