I understand that Illinois is one of the few states that allows this kind of lawsuit. I do not believe that you have to be divorced in order to file it. I would like to know what I have to do, or if there is any place online I can go for more information.

It is my understanding that alienation of affection only applies in the case of married people (meaning you cannot sue your ex-boyfriend's new girlfriend for stealing him from you). It only applies to a legally-bound couple.

That said, alienation of affection is EXTREMELY hard to prosecute in Illinois. You actually need legislative approval to move forward with an alienation of affection case here.

AND state law does not allow for punative damages based on mental or emotional distress or anguish. The only damages for alientation of affection can be REAL, PROVEABLE monetary damages.

Apparently, the original alientation of affection law was so abused that the state did everything BUT remove it from the books.
