:confused: I was supposed to get layed off as of the April 21st. My work is now telling me that they have no possitive date and are making us stay to get severace. The problem is we are not able to look for any other jobs they have only sent out a letter telling us the effective date is April 21st, 2007 and now are trying to keep us till May 30th, 2007 or longer. What should I do what are my options?
Wait until you get laid off,if your lucky they may be redoing the numbers,and some employees wont get the ax. It sounds like good news,although I can see how it would cause anxiety.
If you want to be laid off,for whatever reason,and a lay off is imminent. You could ask the employer to lay you off since they have to lay off anyway.
He may do it,I have seen that done before. Then again he does not have to.

Your options are to wait until the date they ultimately lay you off and get severance, or to leave before hand and not get severance.
Which you should choose is up to you.

So what you are telling me a bit more back round my family is moving at the end of the month I have 2 jobs right now we were told in January about the 21st date of the layoff so we left time for that I am not sure but last I checked you could not be on call past that date as it is not legal to not allow a person time to make arrangements our whole department is getting layed off this is not a good thing since I have made other arrangements.
I don't know where you're getting this but if your potential layoff is due to a merger, plant closing, business closing, sale of business or something of the kind it is by no means unusual for the effective date to be pushed off, sometimes more than once. There is nothing illegal about that.
While they cannot stop you from finding other employment they have no legal obligation to provide you with severance if you don't stay to the final date; nor are they obligated to give you time off to make those "other arrangements". It's your choice; you stay till the date they tell you and get the severance, or you leave earlier and you don't get the severance. They can push the layoff date back as many times as they need to, and they have no legal obligation to offer you severance at all. But while they can't MAKE you stay, they don't have to offer you anything if you don't.

My opinion, take it for what it's worth-
I'd stay until the last day. You get the severence pay then. Why pull out now and lose that? Keep your resume updated, and keep your eyes peeled for another job, though!
