We just found out that our employer is taking our money out for our 401K and not depositing it in our 401K accounts. This have been going on since August so we are losing all that interest.

Is there any recorse for us?

Run, do not walk, to the telephone and contact the Federal Department of Labor. This is the sort of thing employers go to jail for.
