I work for a Masschusetts corporation. Each year beginning January 1st all full-time employees are entitled to 40 hours of personal time. This is immediate and effective as of January 1st. If the employee is terminated or leaves on their own accord, are they entitled to this time. It it not calculated on and "accrual" basis. Thanks.

That depends on what you mean by "personal time". Is this essentially the same as vacation or is it for use only in certain situations?

Since one of the things it can be used for is vacation, my opinion is that it would have to be paid out at termination.
