My employer terminated me in January and provided a letter of termination with specific reasons for firing me.
The reasons were ridiculous. They alleged that my supervisor had asked me not to do something and I did it anyway. However, what my supervisor allegedly asked me not to do was part and parcel of my job, and not doing so was a violation of state and federal law - so if she did ask me to do it, she asked me to do something that was illegal and would risk my losing my professional license.
I disagreed with their reasons and filed an appeal with the NLRB and applied for unemployment. Despite the fact that my employer attempted to prevent me from obtaining unemployment benefits, benefits were approved.
Now, in late March, I received a letter from unemployment stating that they are appealing the decision.
Did they miss the deadline? They fired me on January 29th and now it's the last week of March - isn't there a 30 day deadline or something?
Also, at the appeal, will the focus remain on the termination letter and the reasons they gave for firing me in the letter - or will they be able to make up a bunch of bs and/or other alleged reasons for firing me? (They have a history of lying in unemployment appeals with previous employees.)
In the letter they say why they fired me. I have no problem defending my actions in that regard. If they come up with surprise allegations or lies, I can't really defend against it - it's like proving you didn't do something that was never done.
