View Full Version : Not returning after FMLA, when to tell Tennessee

I have decided not to return to work after my leave. I have vacation time to use until the end of my leave. I am using 16 weeks under the TN law. I would like to tell the employer as soon as possible, but want to get paid my vacation. Can I give notice (including working 2 weeks notice after my leave) and set my end date as June 1, and not be terminated now? Some say company policy is that you have to work your 2 week notice to get paid for any remaining vacation.

We can't tell you what your company policy is, and TN law only requires the payout of unused vacation if company policy says so. There is nothing in the law that protects you from having your resignation accepted immediately upon giving it, but again we can't tell you what your employer will do.

Bottom line; in your circumstances it's going to be entirely a matter of company policy.
