I have been working for my company since mid December of 2006. I am currently 6 1/2 months pregnant. Ive told my boss two months ago that I was pregnant and the job is going to still be here for me when i return. My question is do I qualify for maternity leave? Ive been reading that in New Jersey the company has to have ATLEAST 50 employees? We have about 10...and thats give or take. I have been going nuts reading through forums about this trying to get more info but it gets me no where. Does anyone know what is the law regarding this??

I'm not sure about maternity leave as such (someone else more familiar with NJ leave law will respond soon), but I do know that, once you are deemed medically unable to work, you can file for state disability benefits. Note that SDI benefits are income replacement only, not job protection, however.

Given the size of your employer and your lack of tenure, there is no law that covers you. Maternity leave is whtever your employer chooses to offer.
