View Full Version : Cutting a Full-time employees hours California

My Fiance is currently an R.A. at a assisted living faculity. She is classified as a full-time associate. To my knowledge a full-time associate can not have there hours cut without the employees permission. They are trying to reduce all the full-time employees hours to about 60 per month, but still classify them as full-time. Is this legal ? I remember not long ago the company I work for got sued by the state of california for cutting the full-time associate hour.

I don't know what anomoly was involved in your company's situation but there is no law in CA or any other state that prohibits an employer from cutting an employee's hours, regardless of whether they are full time or part time, without the employee's "permission". Permission of the employee is not required.

Unless the employee has a bona fide contract that guarantees them full time hours regardless, the employer may cut his or her hours as needed with or without permission, in all 50 states.

Now, whether she'll get it or not is a whole 'nuther question. How much were her hours cut? Permanent reduction?

All good questions. Still, a full time employee being involuntarily made into a part time employee is valid grounds to at least try filing a UI claim. My personal favorite however when an employer starts behaving in an unacceptable fashion remains quietly looking for a better employer.
