As Joe stated, your name is not sullied - nobody other than you and the claimant give a tinker's darn about what she testified to and what the ALJ wrote in his decisioni. Plus, this was an Administrative Law Judge (an attorney appointed by the State). not a "judge-judge" and once in a while they make ridiculous decisions. File an appeal of the decision. Based on what you've shared, I'm amazed that the ALJ granted benefits. It will cost you nothing to appeal the decision and the next step is an administrative review of the testimony and evidence given AT the hearing to see if the ALJ made the proper decision. No hearing is scheduled. Hurry, though, as you have a short time period to appeal. Information on how to do that was included in the Initial Determination you received from the State. That sword cuts both ways,if I had a dollar for every bogus firing,as well as bogus records turned over to administrative agencies like the EEOC,as well as a dollar for every,the hooey slung by the employer at these hearings. I do believe I could purchase,every fortune 500 company,all of Americas usable farm land,and still have change left over for the crown jewels. I do believe that it does tarnish my good reputation to have these lies in print on a legal document. I also believe that it could possibly set me up for a future lawsuit, or for other disgruntled employees to make the same claims. I have to wonder what would happen if such a quote made it's way to the newspaper. Or, how many people are reading her copy of this report and forming an opinion about me based on lies. I live in a small town and reputation is important. I agree that lies are told by both employers and employees for various reasons. It may be for financial gain, revenge, whatever... But, there are still honest people left who conduct themselves professionally and don't feel the need to lie. I am surprised that unemployment was granted, especially due to emotional stress. I'm chalking it up to a learning experience. I guess I should have hashed out all of the irrelevant opinions she made and involved myself in a long discussion about every non-issue she mentioned. I incorrectly assumed that I was acting professionally by only discussing issues related to her termination of employment and her health. In the future I'll be sure to take the time to respond to each and every item mentioned. Again, thank you for the relpies. |
