View Full Version : Can employee MAKE you pay for their insurance? North Carolina

My husbands' company has recently changed the policy with their insurance company. He was on my BCBS plan that we loved because it was cheap and VERY good. Then his work sent out a memo that he HAD to show proof of other group covered insurance or he would HAVE to accept theirs. (Theirs is also BCBS BUT it's AWFUL!! No co-pays at all, have to spend $1,000 out of our own pocket before the insurance even kicks in!!) My question is CAN they make him pay for it? They apparently need 100% participation in order for this company to carry the employees. He's out on workman's comp right now and we're kind of hoping they cancel the insurance since the payments are not being made at the moment. (They've also asked him to refill out his W4 and I told him NOT to do it!!) He's been with the company for 5 years. Thanks so much for ANY help you can give me.

They are allowing him to opt out with proof of other coverage. Provide the proof that he is covered under your insurance and they're not going to require him to take theirs.

We already did that. They said since it was individual and not group coverage that it didn't count. They've been taking the payments out every week now since January.

Then there's not much you can do. If they have a 100% participation clause on their plan, that's legal.

But keep him on your plan anyway. If his plan covers so little, yours very likely will pick up some of the difference.
