I'm a smoker. Have applied at a company who will not hire me because I smoke. Is there a law in Arizona about not hiring smokers? I believe it's discrimination against me because of this issue.:confused:

Smoking is not a protected class, so yes, they can not hire you because of your status as a smoker.

I'm understand your comment one way and another person is reading it differently. Can you rephrase your comment (can not hire you because of your smoking status)?:D

No law, either Federal or Arizona, prohibits the employer from refusing to hire you because you smoke.

I have no idea about Arizona, but there are states where they are, for employment purposes. Mine is one of those.

I checked the AZ law before I posted. Smoking is not a protected category in AZ; nor does AZ have any laws protecting "legal activity outside of work hours" like some states have.

I don't know how much this helps, Arizona passed a smoking law. You cannot smoke in ANY place of employment or within 20' of the doors. This is state wide and not limited to local or county decisions.

To my knowledge (and there maybe more) the only state that protects smokers is Louisiana.

In fact....there are cities in Arizona (like Mesa) that have had no smoking laws on the books since the mid 1980's. An Arizona employer may legally refuse to employ you on the basis of you being a smoker.

There are other states besides Louisiana that offer protection to smokers; however, Arizona is not one of them.
