This was already posted in another section but I just stumbled upon this section so i do apologize for the double post. I just think this is a better location for my topic. Any Forum administrators can delete the other post if necessary.


Hello I'm only 21 and I work at a chain restaurant. The schedule is very unstable there and its very difficult to make plans for the week to come. The work week starts on Monday but sometimes the schedule is unavailable to me until very late. Like Today is Sunday and I have no idea when I work next week. Its 2pm and the only day that is finished in the schedule is Monday. I was wondering is this legal in the State of New York? Sometimes Ill be working Monday and wont know if I'm working Tuesday until my shift is over when im heading home.

Laws do not regulate when, where, how or why employers schedule employees.

Bottom line, what your employer is doing is legal, if not terribly bright.

Thanks for the reply wish there was some kind of law or code or something to prevent this but I guess nobody thought anything of it

I am sure someone has thought of it, but there is not a good way to fix the problem.

We put out a schedule on Wednesday covering the following Monday through Sunday. You would be amazed at the number of changes that take place even before the schedule starts.
