I want my husband to adopt my child. He has been there sence the day he was born. The bioloical Father denied him fron the day I found out I was pregnate. It has been three years, and he has never made the effort to see or speek to my son. He is also not on the birth certicicate. Can i get him on child abondoment sence i tried to contact him, I have prof that i tried. Im Afraid that he will not sign over his rights to spite me and then i will have to deal with him in my sons life all the time. I plan on telling my son once he is old enough, but at the age of three he is not going to understand. Please Help:confused: :confused: :confused:

Has the bio dad ever been legally established as the father of your son?
Meaning, has he ever submitted to a DNA test or have you ever signed anything identifing him as the father?

Here is what you do. Find the bio father. Tell him that he either goes to court to turn over custody to your husband or he goes to court to pay CS including back CS.
Trust me, he will sign over rights like it was his idea.

No. I made the decsion to not put him on the birth certificate because he denied him so i thought well i can do this on my own then.

Since he is not the legal father you cannot use abandonment as a reason for an adoption. Your husband can apply for adoption, but the putitive father must be notified first, he can then either give permission or fight the adoption. Cyjeff gave the best advice, talk to ex about giving his permission. If he doesn't want to allow it, then explain to him that you will file to establish paternity AND CS, it will help alot if you explain to him that in Florida the court can order retro support back 2 yrs, and be sure to tell him that you WILL request the full 2 yrs of retro plus interest, in addition to CS for the next 15 to 16 yrs, PLUS a portion of child care costs and a portion of medical insurance costs, plus 1/2 of all out of pocket medical.
You can find the CS laws at www.flsenate.gov/STATUTES in chapter 61. Print out the relevant statutes so that he will know that you know what you are talking about.

no you cant. he hasnt abandoned the child, since he hasnt legally been declared the father. you need to establish paternity first, then get dad's consent, untill that happens, your husband cant adopt your son.
NO- she does NOT have to establish paternity first. The bio dad can legally give his permission without having to establish paternity.
