View Full Version : What is Ohio Law for not getting your paycheck on time Ohio

I was recently terminated from my job with out just cause. They did offer me a severance pacakage however the pay has been late every payperiod. It is very late this time and they are saying to wait until next Tuesday and if I don't receive it they will start the process to reissue. Up unitl this happen my checks were directly deposited and always on time. Since then they have been late, put on a paycard that cost me money, and very late. What can I do?

Not much. First of all, Ohio has very few wage and hour laws of its own. Secondly, severance is not "wages" under either Ohio or federal law.

If you have a binding severance agreement that specifies the terms of payment, there MAY be a breach of contract, but only an attorney who has reviewed the document in its entirety would be able to tell you and, if there was, what your legal recourse is.

Thank you. I do have a binding severance agreement. It does list the dates I am to be paid. I guess I am going to have to get an attorney involved.
