My husband drives trolleys on the strip for tourists. The company he works for changed their way of paying the employees from hourly to commission a few months ago. He works 12 hour shifts 4 days a week. His commission is made from the amount of people he can get to ride his trolley. If it is a slow day he can work for 3-4 hours without a single rider. The first $40.00 he makes for the company he keeps and then something like 5% from the rest. My problem is this. Today he went to work at noon and the trolley they gave him broke down. And the second one. And this is his 3 trolley today. Most of his time was spent at the office waiting for them to give him another one. If he does not make any money for the company then he does not get paid. Is there some kind of law that says he has to be paid at least min. wage? Or is it legal to work in NV. for 100% commission even if you make no money some days?

I think the problem with your logic is that you are looking at one-day as a stand alone. You need to consider all days within the workweek. The workweek is a predefined seven-day period. It does not have to be a calendar week. In the course of the workweek, is your husband being paid enough to make at least minimum wage for all hours worked in that week?
