View Full Version : Unemployment Appeal/What do I do? New Jersey

Hello everyone. I really would appreciate if anybody with some knowledge on the subject can post or email me with any advice.

I was fired in early January of this year. I had missed a week of work due to family problems and sickness. When I spoke with the boss he advised to take the time I need and to keep him informed. He then had me call him and fired me over the phone the day before i was going to come back to work. I explained the situation and he advised that it wasn't because of that but he said 'word for word', that I just wasn't a good fit. I was hired for one position but 3/4 months in when another employee quit to work elsewhere my job load doubled and I was doing totally new things that I was never trained for. I begged him to keep me along until I can find new work as I explained that i just moved out of my house and am paying rent for the first time but he just said no. The next day I filed for unemployment and had a phone interview and was granted unemployment by the lady who heard both sides of our story. I have been receiving the benefits with no problem but earlier this week got a letter in the mail saying there was an appeal. He filed an appeal over a month later. The money I had been receiving has been put directly to my bills, I have been looking for work this whole time but have come up unlucky as of yet. Now I got a letter saying I have a phone interview with an appeals examiner. I am not sure what to do at this point. I am more afraid of having to pay back money that I no longer have then losing my benefits even though I think both would be un fair considering the situation.

Sorry for the long paragraph but I am unsure if I should obtain a lawyer or to not even bother considering I missed like 7 days of work, but the boss had told me to do what i had to do for the family. It was a severe sickness and then death in the family. I was in the hospitol for 2 days when she was sick, then missed 2 for the services and funeral when she had passed, and then was having a hard time and was in mourning/grieving. Please someone help me figure out what to do.

It appears you have nothing to worry about. When you receive the notice of the hearing, be sure to attend and just answer the examiner's questions. Nothing in your post suggests you were terminated for a reason that would make you ineligible for UC benefits.

No, you don't need an attorney. These hearings are very routine and not a big deal. Good luck.
