Hi,
I have worked for a company for almost 2 1/2 yrs on hourly wage basis. I decided to quit the job as I had to join a university. When I disclosed this to my employer he withheld my last 15 days paycheck (around $2,600). A direct deposit was made to my account and was rolled back after 7 days without any notice.
I have original copy of the time card subimmited for this period. Could I file a case against them in small claims court? What is the best way to get the paycheck in this case?

Your help would be greately appreciated.

Thanks!

It is a heckuvalot easier to report the unpaid wages to the either the State or Federal Department of Labor than to go through the small claims process.

Has your employer told you why this was done?

Thanks for the prompt reply!!
I did email him asking for a reason after a month but he did not reply back.
I am not sure of the exact reason, I am guessing that it could be because I quit the job on a short notice of 10 days. I did try to inform him earlier but he was out of the country and was not reacheable.

If you worked, you must be paid.

File the wage claim.
