Well I just recently turn 16 in November and My setp-dad, mom and I have been talking about my step-dad adopting me, I was wondering if I could make my own decision about being adopted and not have to get my biological fathers consent.:confused: He has not paid any Child Support EVER. He has had contacted with me but not very much. The last time I heard from him was november for like 30 seconds over the phone and before that it was like 2 years ago.

Your father's consent will still be needed or a court will have to involuntarily terminate his parental rights. In either case, YOUR consent will also be needed.

he will either have to approve or have his rights involuntarily terminated. since you are over 14, you will have to approve of the adoption. Has your bio dad had any contact of any kind including paying CS? your mom would have to file along with your stepdad to do a TPR/stepparent adoption

In many states it is also possible to do an "adult adoption" once you turn 18. All that would be needed is your consent & the consent of the adoptive "parent" in most cases. You being a legal adult would have the right to do this with out your bio parents consent. The laws varry state to state. Some states allow it very openly(and 2 adults for reason of inheritence), other only under certian cercomstance(step parent), and some restrict it or do not allow it at all. If you are unable to do a step parent adoption now....this might be an option 2 years from now when you turn 18.
