View Full Version : Should I have been paid my O.T. in Oklahoma? Oklahoma

I was employed at a non-profit organization for about a year. I have alot of checks stubs for over 80 hrs in a two week pay period in which there is no o.t. pay except for one and they only gave me 19.75 hrs of ot and 89.25hrs of regular pay. They also gave me 2 seperate checks once for one pay period and the hours total 101.50hrs but broken down into 2 shows 79.75 hrs for one check and another for 24.75 hrs, but it should have been on one check. They also didn't pay for any hoilday pay, can they do this? when questioned about it they said they didn't have to because they are a non-profit orgaization, also got this answer when hurt on the job and thought i should have got medical treatment. can they do this?

IF they are subject to the FLSA AND IF you are a non-exempt employee, then yes you should receive overtime if you work over 40 hours in a week.

They have no legal obligation to provide holiday pay.

how do i find out if they are subjected to FLSA? They have workplace rights posters there.

If EITHER of the following is not true, they are subject to the FLSA:

1.) Their gross annual income is under $500,000
2.) They are involved with no interstate commerce whatsoever. That means they don't make so much as a phone call out of state; they neither buy, sell, or ship so much a a toothpick (from) out of state.
