Hello,

As part of a divorce settlement I plan to give my wife the house.

It has many problems with it including violations of the National Electric Code.

Due to a restraining order, I am unable to get back into the house to fix anything.

How can I give her the house and not be held liable in the future if there was a mishap because of electrical code violations.

One example is I installed a ceiling fan on the same circuit as the washing machine, which is not allowed.

If you disclose everything you know wrong with the house and there is a house inspection by a neutral third party, no one can gripe at you later when there is something wrong.

Don't look a gift house in the mouth.

If it is really a gift, you lose all interests in it - positive and negative. I saw a court case on TV about that today.

The plaintiff sued the defendant for repairs on a car the defendant gave her. She wanted the money for the repairs, not the car.

The judge said: Do you want the car, or do you want nothing? It's your choice. You can't get the money. A gift is forever.

However, if you get something else in exchange for the house, it is not a gift.

Oh, one other thing. In a divorce settlement, the person who gets the house normally gets the mortgage payments too.
