View Full Version : so, I had to be hospitalized for a week and got docked big time New York

This is just a big mess. I seeked advice from my bosses whom are therapists, they suggested I seek treatment at an inpatient facility. They told me to take as much time as needed. I was hospitalized for a week and when I came out my boss told me that I needed to get a letter from a psychiatrist stating that I am able to return to work. The inpatient facility had booked me an appt with a psychiatrist in which the earliest available appt in my insurance network had me miss 3 extra days of work. Altogether I missed 10 days. I finally got my letter stating that I could return to work. I picked up my check and got docked all of those days. Is this legal? I could understand if I just took off for no reason at all but I was hospitalized I just don't understand. I am a full time employee. :confused:

Why would they pay you for those days you did not work and were off for personal reasons? If you have sick leave to use did you request to use it to cover?

Regardless of whether you are full time or part time, the law does not require that you be paid for time you do not work, even if you are hospitalized. This assumes that you are a non-exempt employee.

If you are exempt, then whether you can be docked for this time depends on whether your employer offers paid sick days or not and if so, how many.
