View Full Version : Resignation declined, can I still get paid? Ohio

My husband had a branch manager job and put in his 2 week resignation but they declined it. I was told that they still have to honor it like a paycheck and still pay him for the 2 weeks. Is this true in Ohio? My other concern is that we got information in the mail that our health insurance was cancelled on his "so called" last day. Isn't it a federal law that we are covered for 30 days with the option of Cobra? We got the notice a week later and in it said that coverage was terminated on the 5th and that we would receive Cobra information soon. It is so hard to find any informaiton on labor laws so I am hoping to find some help here. Any info. would be greatly appreciated.

I take it they did not decline the resignation, but the notice and terminated him immediately.

They are not required to pay him anything for the two weeks he would have, but will not, work. He MIGHT be able to get unemployment for those two weeks.

The company has 44 days to give you notice of Cobra eligibility. If you are eligible (and I assume you will be), you will be on the hook for the full payment of the insurance from the date that the company sponsored insurance ended. It won't be cheap, but it is probably better than what you could get through an individual plan.

And no, there is no Federal law requiring them to continue covering you for an additional 30 days. And it is not true in any state that he has to be paid for the unworked notice. It stinks, but it's legal.

Let me clarify the COBRA part.

Even though the company has 44 days to get you the information, you will be covered for anything medical that happens between the date of termination and the limit provided in the documentation provided that you make the first payment on time.

In other words, the COBRA will reimburse you for any charges provided you make the payments by the deadline provided in the documentation.
