Hello,
My wife left a retail company in January. She lost her vacation pay, because she didn't give a full 2 week notice. My problem is that she worked 4 days during her final week, but was only paid for 3 days. She has been dealing with the company for almost 1 month, and still has not gotten her last day. She called again today, and was told a check for 6 hours was being printed, and would be sent to her. She was only scheduled for 6 hours on her last day, and she worked her shift. The reason for the 6 hour shift was because the Managers were still on 6 day weeks getting ready for inventory. She was normally paid 8 hours per day. although she was scheduled 10 hours per day. Why during her last week was she only paid for 6 hours, even though the 3 days she was paid for were 8 hours each, and she worked a minimum of 10 hours each of those days. Can she get the rest of her money? It is only 2 hours, but she earned the money.

As an exempt employee, her pay can be reduced to just the hours worked on the last day of work. If she worked 6 hours on her last day, that's all federal law requires she be paid. Actually, I questioned this too a little over 2 years ago when I was let go from an exempt position. I called the federal DOL, spoke with an investigator, and that's what he told me.
