Hello. My husband and I have a three bedroom house and one roommate. We signed on a contract for a year up to Aug.31,07. By then, I was 3 month pregnant, and had plan to have my sister (from other country) come help me for 3 month in March - May 07. Recently, my mother-in-law (from other country, also) offered to help us for a year from April 07 - March 08. We need to have our roommate move out by April 30, 07. We gave her a notice on Feb. 7th, 07, but she does not want to leave. What can be done? I have two of my relatives coming in from other country, but don't have a place for them to stay. Can we break a lease with our tenant? Please help me. My due date is Mid-March,07. Thank you

If you break the lease, your tennant can rightfully sue you. You have a binding lease. It's not the tennant's fault that you want your family to come stay with you. The tennant has done nothing to legally warrant your breaking the lease. I suggest that if you want to force your tennant out, you offer a substantial financial incentive to him (her). If you don't, you will be ordered by a court to pay the financial incentive. Only in that case, you will have a judgement against you.
