Have another issue with the new job:

I have to travel for my new job, and was wondering how I am to be paid. I am an hourly employee + commission (I am only hourly for my 1st 90 days, as a probation thing). I am not sure if I am exempt or non exempt, but I do get paid overtime, have med benefits, receive paid holidays, vacation and sick leave. I have travelled a lot for work already and as an hourly employee, how am I to be paid?

Example, Feb 4, Super Bowl Sunday, I had an 11am flight for a conference that did not start until 8am Monday, Feb 5. Am I paid for Sunday? I am not technically working, but I am away from home, and inconvienced.

Also, I stayed at my destination (expensed by the company) until Feb 7, where I flew home on a 6pm flight, not getting back home until 11pm. My company only paid me for the time I was in training, is this legal? Do they have to pay travel time, since I am an hourly employee?

Since you are being paid hourly, you are, at least for this period, being treated as a nonexempt employee.
