My daughter (age 19) is a camp counselor in New York. When she took the job, her rate of pay was $1,100 for 8 weeks (or ~ $3.30 / hour). At orientation the camp told her that she would receive tips from the children in her camp group. However, when she arrived for work, she was not given a specific group but was designated a "floater", going from one group to another (for example, if a counselor called in sick, etc.). She complained about this, in part, because since she did not have a specific group, she would not receive any tips. She questioned the camp leader who said, unfortunately, that she would not receive any tips. My question: Given these circumstances, is she entitled to receive minimum wage?

According to the Federal Labor Standards Act, wages, including tips must be at least $5.15 per hour with 1.5 times normal rate for any hours over 40 worked.
Tipped employees may be paid $2.13 per hour minimum, but total wages for the week must add up to a minimum of $206 per week, and if not , the employer must make up the difference.
